1. Política de Privacidad

REVIVACK CIRCULAR ECONOMY, S.L. -hereinafter REVIVACK- informs users of the processing of their personal data to manage their relations with us through the website, in accordance with current legislation, which currently consists mainly of Regulation (EU) 2016/679, of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter, GDPR), and Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights – hereinafter, LOPDP-.

1.1- RESPONSABLE DEL TRATAMIENTO

The person responsible for data processing is REVIVACK CIRCULAR ECONOMY SL., with VAT number B-66363243 and address at C/ Rocafort, 12, 080015 Barcelona and e-mail: hola@revivack.com.
Co-responsible for treatment.

1.2.- DATOS QUE SON OBJETO DE TRATAMIENTO

REVIVACK may collect the following personal data from users of the website through the relevant forms when the user visits the website and registers, bearing in mind that not all of the data listed below are used for all data processing, but only those indicated in section 3 on the purposes of processing:

a.- Identification data: name, surname, NIF.
b.- Contact details: telephone and e-mail address.
c.- Geographical data: country, city, and postal code.
d.- Product data: description, weight, brand.
e.- Financial data: credit card number, in accordance with PCI standards.
f.- Company details: name and VAT number of the company represented.

1.3.- FINES DEL TRATAMIENTO AL QUE SE DESTINAN LOS DATOS Y BASE JURÍDICA DEL TRATAMIENTO

1.3.1.- The data will be processed for all or some of the following purposes, with the legal basis of the user’s consent (article 6.1.a) RGPD, unless another legal basis is expressly indicated:
a.- To manage and develop the user's registration on the Revivack website. In the case of users who return products -hereinafter, «consumer user’s», the identification, contact, geographic and product data will be processed, and this will allow them to access the return process by receiving the necessary information for this purpose. In the case of users representing companies – hereinafter, «company user’s» company data will be used, and this will allow them to manage the participation of the represented company in the product return process.
b.- Manage and develop the process of returning a product to a brand or recovery centre. The identification, contact, geographical and product data of consumer users will be processed in order to process the delivery to their destination through the return channel they have chosen from among those that, where appropriate, are available for this purpose if there are several, and to transmit by e-mail and/or SMS the information
that the manufacturer or recovery centre generates about the return process. Possible pseudonymisation of the product from the moment it reaches the manufacturer.
c.- Manage the payment of a price for the cost of the return at the expense of the consumer user, or the collection or receipt of financial or other compensation, in favour of the consumer user, and the issuing of the corresponding accrediting documentation. The identification, contact and financial data of consumer users shall be processed for this purpose.
d.- Direct marketing activities aimed at personalising the offer of products and services based on data analysis. If expressly consented, REVIVACK will process the identification, geographic and product data of consumer users, as well as the information received from the manufacturer or recovery centres through the Revivack website, and their browsing history on the website, in order to create a user profile.
The purpose of the profile will be to evaluate the preferences, needs and personal interests of the consumer user, with the aim of offering him/her a better navigation adapted to his/her profile; to provide him/her with information also adapted to his/her profile, about other products that can be returned and the conditions of return (such as return channels, or rewards, among others); to offer him/her participation in
promotions; and to offer him/her participation in surveys that allow us to adapt the website to the needs of the users.

1.3.2.- The forms have an asterisk (*) in the obligatory data. If the user does not provide these fields, or does not tick the box to accept the privacy policy, it will be understood that they do not consent to the collection of their data and this will prevent the return process from being carried out in general, or the provision of the service or performance of the activity for which the data thus indicated is collected.

1.3.3.- The user guarantees that the personal data provided are truthful and correspond to the real, updated and accurate situation. In order to make effective the return process of all products, it is essential to keep the personal data updated, so it is recommended to all users to inform REVIVACK about any modification of the same that takes place, so that REVIVACK will not be liable for the consequences arising from any inaccuracy or obsolescence of the personal data provided by users.

1.4.- DESTINATARIOS

1.4.1.- The data of business users will be communicated to the manufacturer, other recovery centres, and in general to other companies that participate in the process of returning the product or part of the product in which it participates, insofar as this is necessary for the complete and adequate development of the process, including for example companies that provide the necessary services for this purpose, such as
transport and logistics, financial institutions, or technological service providers.

1.4.2.- The data of the consumer users will be communicated to the manufacturer who is to receive the product from them, so that they can give the necessary instructions for the collection of the product, verify its correct reception, safeguard the separation and recovery process, and any others necessary for the complete and adequate development of the process, including companies providing the necessary services for
this purpose, such as transport, or technological service providers; and to inform them about the development of the return process (location of the product, status of the process, destination of the product).
If the consumer user consents, his identification, contact, geographical and product data will be communicated to the manufacturer for the performance of direct marketing activities related to products marketed by the manufacturer, including the promotion and offer for the purchase or return of other products, the performance of product satisfaction surveys, or the elaboration of profiles to assess the preferences, needs and
personal interests of the consumer user, with the aim of offering him commercial information also adapted to his profile. If the consumer user consents, his identification, contact and financial data will be
communicated to the manufacturer for the collection of the return handling fee or for the payment of compensation.

1.4.3.- Data will only be communicated to companies that offer sufficient guarantees of lawful, fair, transparent and appropriate data processing for the purposes for which they are communicated, and with appropriate security for their integrity and confidentiality.

1.5.- PLAZO DE CONSERVACIÓN

The data will be kept as long as the user does not cancel their account with REVIVACK or revoke their consent, without prejudice to the retention of those data that are essential to comply with the legal obligations arising from the relationship maintained with REVIVACK until that date, and to allow the processing of claims during the limitation period of the actions arising from the relations maintained.

1.6.- EJERCICIO DE DERECHOS POR EL USUARIO

Users may exercise their rights of access, rectification, opposition, deletion, limitation, portability of their personal data, not to be subject to a decision based solely on automated processing, including profiling, and to withdraw consent, by sending an e-mail to hola@revivack.com, enclosing a photocopy of their ID card or equivalent identification document.
Furthermore, users may file a complaint regarding the processing of their data with the Spanish Data Protection Agency, by means of the different means offered on its website www.aepd.es.

1.7.- MENORES DE EDAD

The REVIVACK website and its forms are not intended for minors under 14 years of age and you accept that you are over 14 years of age. Access to and use of this portal is prohibited without the consent of the holder of parental authority or guardianship and provided that this has been granted in accordance with the powers legally vested in the representative.

The Data Controller reserves the right to check the age of the users, and if it detects that a minor under 14 years of age has provided personal data, it will proceed to the cancellation of the same.

1.8.- RESPONSABILIDAD DE LOS CONTENIDOS

REVIVACK is not responsible for the legality of other third party websites from which the REVIVACK website may be accessed, nor for the legality of other third party websites, which may be linked or linked from its website.
